Jill, I know somebody who was let go with no reason. Basically they fabricated something to get rid of her. She found an attorney and he couldn't find enough reason to pursue wrongful firing, something to do with being an "At Will" state. The attorney wasn't interested since he would have been working on a contingency. But after talking with her he discovered she had been working in the store off the clock for years, with the managers full knowledge. They were able to produce a huge paper trail proving she was there when she wasn't on the clock. She got a very large settlement.

These people don't sound like they follow rules so there has to be something you can get them on. The sexual behavior alone is enough but you do need witnesses or proof of some kind. It definitely pays to consult a lawyer, they know what to look for. Good luck,

Jill, these people really deserve "a boot in the bum" so to speak. Please help make this happen, it will make the world a better place when the type of treatment you got is gone.
 
How a company treats their employees reflects on the integrity of the work they do.

If we don't respect the people that work for us, we probably don't respect the customers who trust us.

I wish you good luck with PFM on the instructor job. I sent in a resume to them twice and got no answer other than they weren't taking any instructors now. I don't understand why they are still advertising if they don't want the instructors.

(Maybe they simply don't want ME.) :confused:

UMS was also advertising for instructors. Check them out, there may be something for you there until you get your own shop rolling.

Okay all, time for the next chapter:

Titled would you believe..I just received a phone call from Ben Franklin Crafts, An alicia in the frameshop had a question.

I was childish and informed her I no longer worked there and would not be answering any questions. Then hung up.

Am I wrong or should the manager be giving my unlisted phone number out to people I do not know?

It Just keeps getting better :mad:

I think one of the things you will learn when you get your own shop will be not to burn any bridges. You could have asked for consulting fees to answer their questions, by gosh!!!
But you'll look at things different later.

Did you get your book back from the manager yet?

I havent gotten it yet I am hoping I will get it when I go in for my last pay check on tuesday.
But I wont be holding my breath.
I still can't get over them calling me this afternoon.
 
Call ahead and tell them you will be stopping by on Tuesday to get your check and that you would appreciate if they would have the book handy for you to pick up. I hope they will take your call.

It's difficult to deal with that kind of situation and not take it personally. Maybe the offenses toward you were intended to be personal; intended to make you want to quit. If so, shame on them.

As a general rule we should try to separate our emotions from business decisions. This takes practice, and sometimes it is not easy to do. For example, when Alicia called with the question, I think it would have been better to react objectively and unemotionally.

ArtLady's suggestion about asking to be paid for your help is a good one. Objectively, you would be in control of that situation; you could ask whatever price you want. But from a business viewpoint, it's best to make your price no more than the cost of whatever alternatives are available to them. Also, you could decide that you do not want to be involved for less than $XYZ, or not at all, based on business reasons; not personal ones.

In any case, unloading on Alicia probably wasn't the best reaction. Put yourself in her shoes. Maybe she was instructed to call you. Maybe she didn't fully understand your feelings about the separation. Maybe she's now in the spot you used to be in, and truly needs help. She may be the next one to be mistreated as you were.

Bridge-burning, as others have said, might give you instant gratification, but usually there's a better way -- a way to capitalize; a way to gain advantage.

In the words of an old sage; if you're a bull at the top of a hill overlooking a herd of attractive heffers, resist the temptation to run down and take one. Instead, walk down and take them all.
 
When you open your own shop, grow to a point where you need to hire an employee, you may need someone with the experience Alicia may have by that time.

You have received excellent advice here. My I add one more crucial piece?

Get a lawyer with experience in this area. Do not base this decision on price. This is a case where you absolutely get what you pay for (yes, MM, I know). In this case it will be contingent so you will not pay unless you get a judgment or settlement, and then it will be out of the proceeds of that. And, please, don't begrudge the lawyer that money. Believe me, they work for it.

Most importantly, do this for yourself and for the future victims. I'd guess that if someone had followed through and sued that manager in the past, you would not have had to go through this.

Jill all good advice. You have some take legal action some saying don't burn bridges? I have had a boss like this, They would work on one employee then when take one would quite they would hire a new one a few weeks later then target a different one make their working life miserable untill they just quit. I worked for two years under them then I became their target I had seen it three times unjust evaluations and just mean and abusive treatment. After the second time I saw this person intentionally and with out just cause literally destroy a very fine person. I methodically documented every thing and told the person just what Your fellow grumblers are telling you now go legal. I got former employee phone numbers and kept in touch. Sure enough after about 1.5 years I had become the target. I SWORE as soon as I found a job I would go the distance on this boss and the other employees said they would back me up. But when the time came none of them wanted to open old wounds and they were happier now at their new jobs. But I SWORE to help defend and prevent this from happening again. But one week after leaving And the lack of support I was just glad to be happy at my new job. Just Plain glad not to have to deal with this person any more. This person is still in business some 30 years later They are still not a happy person. About 10 years ago I met him at a large Black tie social event. And when standing around with some of the communities elite. I point blank asked him if he was still abusing his employees the same as when I worked for him and reminded of the very fine person he stomped on the hardest and how he did it. His only reply was no I don't really recall that. I have interviewed people who have over the years worked for him and he is still the mean spirted person he was then. The stories are all so simular asked why they did not go after him they almost all say the same thing glad to be clear of him. I guess no one has ever gone legal on him yet. So it just confirms what he does to people That he can do anything he wants and no one is going to do anything about it. It Takes a very very strong person to pursue legal against an ex employeer. My Hat is off to you what ever direction you take.

Dear Gumby,

It is all very sad. The old boss is a victim of his own loss. It takes months to get someone up to speed. The smart ones are beginning to realize the resources needed to train a new person. That is why personnel is now called human resources.
 
Hey all,

I am just about to go and try to get my last pay check. I called the assistant manager monday night to verify that it would be there waiting for me: first he said I would have to turn in my apron and name tag then admitted that I already had after confiring with Merchandising manager.

Now they claim They can not find my things that were still there namely a picture framers rule, and my glasses.

We'll see in about 1/2 and hour how they plan on handeling these things. I need the glasses for distance.

I also found out they are questioning my eligeablity for unemployement the phone interview is tomorrow at 1:00pm.

On a up note I think I may have found a shop to purchase didn't think it was the thing the first time round but the owner has sweeted the deal and is willing to work with me.

So things are getting better and worse.
Am looking into the lawyer also have had a few private e-mails that have had some terific info and a few phone calls to.

Thanks can not begin to express my feelings inregards to all the help and emotional support that everyone has given me. It has stopped me from hiding which is all I wanted to do when this all started.

Your PS contains good revenge, but try to get up the courage to get more by stopping these people. How did the paycheck pick-up go?

Gumby's experience is too common, and is the reason abusers continue to abuse. This is not meant to judge, just an observation.

Most abusers do not know that they are abusing. They would say this is just my style and do not understand that people consider it abuse.

Anyway LIVING WELL IS THE BEST REVENGE!!

So JillCPF, if you want revenge open your own shop and do well. We will help you.
 
Yes, introspection and intellectual honesty are not hallmarks of abusers. AL, are you sure you aren't a clinical psychologist? ;)

Well as the frameshop turns continues...I did get my paycheck, They did not return my tape measure or my glasses :rolleyes: but I did get my book.

As to the unemployement interview apparently the fact that I had reqested and recieved a copy of my employee file 5 weeks ago sliped their minds... they loaded it, with employee compailnts from 2 years ago, coplaiints form a customer that I didn't let them see all the samples they wanted and they could only take home a few to see if they matched their decor. Then Patty said she did not shake a ruler at me, there were no witnesses! The unemployment lady seemed very intrested in the fact that I had not signed any repramands and was not aware of these complaints.

We'll see how the axe falls but I will take this trew every appeal if I have to I deserve that unemployment.

I allowed myself a few hours of self pity then went and filled out another job aplication, One must fullfil all the unemployment requirements well you wait....

IF I could live off unemployeement I think I would not Really find a job until it was close to running out. As a matter of fact Most places probably won't need framers until the next holiday season.(dec - nov) 2003 he! he! he! As A matter of fact come to Ohio I have a place you can stay rent free and hang out at my frame shop!

So they loaded your file with a bunch of BS, and you have a copy of the original unsullied file? The fact that you did not sign any of the reprimands or complaints means essentially that they were never brought to your attention and you never acknowledged them. Which all means it didn't happen. Sounds like the lady at the unemployment office thinks the same. I'm sure your lawyer would be interested to know they had falsified your file.

Be glad you were able to get your check without any problems. I once left a place and it took me 4 months to get my last check. First it was an "inventory issue" they needed to clear up over two boxes of foamcore (who in heck would steal boxes of foamcore anyway??) and then a problem with the payment of an order picked up after I had left, and on and on. It took a call from a lawyer followed three days later by a call from the hours and wages board to get it.

Call a lawyer NOW. You need help NOW. Your former employer may be playing games behind the scenes.

In Ohio, all employers pay into a state fund for unemployment compensation, and their annual "contribution" goes up or down depending on the number and amount of unemployment claims paid. Every claim costs them, so if they can weasel out of their obligation, it's money saved.

Wisconsin law may be different, but in Ohio, unless you were fired for "just cause" or simply quit, you would be entitled to compensation. A lawyer can help you with that, especially if harrassment was involved.

Ohio law may be typical. Here, if an employer claims that an employee was fired for "just cause", proof of that is required. A few offenses are slam-dunks, such as coming to work drunk, threatening behavior, assaulting others, etc.

But if the employer claims that you were fired for an accumulation of minor offenses, they may (should) have to prove:

A. That some disciplinary procedure is written into company policy, is well known to all employees, and is consistently applied to all empolyees. That usually involves a reminder of rules for a first offense, then a reminder plus some discipline for a second offense, then more severe action for subsequent offenses. The employee's file should be updated with details all through the process. Disciplinary action should leave a "trail" of file documents that can be used to reconstruct the sequence of events. Employee signature isn't often required, but it helps.

B. That you were aware of the offenses

C. That the appropriate disciplinary action was initiated and documented in your file.

D. That you knew of the disciplinary action to come, and were given an opportunity to avoid it by meeting specific goals of improvement.

If there is no written policy on discipline, then the authorities have reason to believe that the company has inconsistent discipline, and might judge that the company discriminated against you.

That said, I would urge anyone who receives unemployment compensation to get back to work as soon as possible. It is intended as temporary assistance, not a job substitute.

A long time "on the dole" tells prospective employers that a job applicant may lack motivation. We're always curious when there's a long break between jobs. If you receive compensation for six months and a prospective employer asks "Why didn't you apply for this job six months ago?", make sure your answer is credible.

A) It will get your missing things fast .

B) It may get you some compensation

C) It may teach them a lesson in business practices despening up on punitive or settlement amount.
